The ability to sue someone for money owed is one of the many liberties afforded to us by small claims courts. Unfortunately, the ordeal doesn't always end with the judgment. Sometimes a plaintiff must hire a third-party to actually collect the funds for them.
For this reason, The Legal Process is pleased to offer our clients several post judgment recovery packages. California law gives a defendant 30 days to appeal any judgments made against them. After 30 days if the defendant has not filed an appeal or begun making payments on the judgment, you can legally begin post judgment proceedings.
To collect on a judgment you've already been awarded, you will need to find out how much money the defendant has and exactly where it's located. This is done by filing an Order of Examination of a Judgment Debtor (JDX), a court order which requires the defendant to produce a statement of assets that you and the court can examine. You will also need to issue a subpoena duces tecum, which orders the defendant to appear in court with their financial documents that you requested.
