California Property Liens
The State of California allows its citizens and business owners to impose a lien on property owned or a persons name by a debtor when they have a judgment. The lien holder does not take ownership of the property. However, he or she could collect payment from the subsequent sale of the property or if the property is refinanced.
The majority of property liens are imposed against real property. Real property is defined as land and any permanent structures that are built on it, such as a house, office building, or hotel. If the debtor does not own any real property, creditors can also place liens on their personal property.
Personal property can either be tangible or intangible items. The general definition of tangible personal property is anything that can be touched, felt, weighed or measured and includes things like office furniture, cars, and jewelry. Conversely, intangible items like copyrights, patents, and securities have no physical existence.
In the State of California, there are different procedures for imposing property liens against real property and personal property. Once more, the forms you have to file can vary from state to state.
